1. Rental Agreement & Equipment

• Condition: The Participant acknowledges that the bicycle and equipment (helmet, locks, etc.) are received in good working condition.
• Proper Use: You agree to use the equipment in a manner for which it was designed and to follow all local traffic laws.
• Security: You are responsible for the bicycle while it is in your possession. You must lock the bike to a fixed object whenever it is left unattended.

2. Guided Tours

• Itinerary: ride-therapy.ro reserves the right to modify tour routes due to weather conditions, road closures, or safety concerns.
• Punctuality: Participants must arrive at the meeting point 15 minutes before the scheduled start. Late arrivals may be treated as “no-shows” without a refund.
• Physical Fitness: By joining a tour, you certify that you are in good physical health and have the necessary cycling skills for the chosen route.

3. Safety & Helmets

• Safety First: Helmets are highly recommended. If you choose not to wear a helmet (where permitted by law), you do so at your own risk.
• Conduct: We reserve the right to remove any participant from a tour who acts in a way that endangers themselves or others, without a refund.

4. Liability Waiver & Insurance

• Assumption of Risk: Cycling involves inherent risks (accidents, terrain, weather). By using our services, you voluntarily assume all risks of injury or damage.
• Waiver: ride-therapy.ro is not liable for any personal injury, death, or property damage sustained during a rental or tour.
• Personal Insurance: We strongly recommend that all participants have their own health and personal liability insurance.

5. Damages, Theft, and Loss

• Damage Fees: You will be charged for any damage to the bicycle beyond normal wear and tear.
• Theft/Loss: In the event of theft or total loss of the equipment, the Participant is liable for the full replacement value of the bicycle: €3000.
• Reporting: Any accident or theft must be reported to ride-therapy.ro and the local police immediately.

6. Booking, Cancellation, and Refunds

• Cancellations by You:
  • Full refund if cancelled 48 hours in advance.
  • No refund if cancelled within 24 hours of the start time.
• Cancellations by Us: If we cancel a tour due to extreme weather or unforeseen circumstances, you will receive a full refund or the option to reschedule.

7. Participant Age and Consent

• Participants under 18 years old must be accompanied by a parent or legal guardian who signs the waiver on their behalf.

8. Governing Law

These terms are governed by the laws of Romania. Any disputes shall be settled in the courts of Sighisoara/Mures.

9. Special Provisions for Electric Bikes (E-Bikes)

• Battery Care: The Participant is responsible for ensuring the battery is used according to the instructions provided. Do not submerge the motor or battery in deep water.
• Range: Battery range is an estimate and depends on terrain, rider weight, and assistance level. ride-therapy.ro is not responsible if the battery runs out during your rental.
• Speed & Regulations: E-bikes are limited to 25 km/h (as per EU regulations). Tampering with the speed limiter is strictly prohibited.
• Additional Value: Given the high value of E-bikes, the Participant acknowledges a higher liability fee in case of theft or total damage (up to €3000).

10. Weather Policy

• Operation: Tours and rentals generally operate “rain or shine.” We recommend participants check the forecast and dress appropriately.
• Safety Cancellations: ride-therapy.ro reserves the sole right to cancel a tour or rental if weather conditions are deemed dangerous (e.g., thunderstorms, extreme heat waves, heavy flooding, or high winds).
• Refunds for Weather: In the event of a cancellation by us due to dangerous weather:
  1. You will be offered an alternative date/time.
  2. If rescheduling is not possible, a full refund or voucher will be issued.

Customer-Initiated Cancellation: Fear of light rain is not grounds for a refund unless the cancellation is made within the timeframe specified in Section 6.
